Sworn Translation
Only sworn translation (certified translation) is officially recognized by different institutions and public bodies in Brazil and is valid as an official or legal document.
Pursuant to Decree N. 13.609, of October 21, 1943, “No book, document or paper of any kind that is written in a foreign language, shall take effect in offices of the Union of States and municipalities, in any instance, Court or Bench or entities maintained, supervised or guided by public authorities, without being accompanied by the respective translation made pursuant to this regulation”.
Therefore, a foreign language document that has to be presented to the Brazilian Justice or filed with the Registry of Deeds and Documents (CDT) or in other types of registries, you will mandatorily need to have the sworn translation in attachment.
The documents that most commonly require sworn translation are: minutes, driver’s license, birth certificate, marriage and death certificate, school documents (Prime School and High School certificates, university diplomas and school transcripts), certificates of origin, contracts, case file documents, documents of foreign vessels, manifests, passports, powers of attorney, judgments and last wills.
Sworn translation can only be performed by a Public Translator and Commercial Interpreter, also known as a Sworn Translator. This professional, qualified in one or more foreign languages and Portuguese, is nominated and registered at the board of trade of its state of residence after approval in a civil servant examination.
